Welcome to HiveNow. These Terms & Conditions govern your use of the HiveNow app, website and services operated by Beelyn LLP (“HiveNow”, “Hive”, “we”, “us” or “our”).
By accessing or using HiveNow, you agree to these Terms. If you do not agree with them, please do not use HiveNow.
1. About HiveNow
1.1. HiveNow is a technology-enabled fashion marketplace and fulfilment platform that enables customers to discover and purchase fashion products from participating brands and retailers and receive eligible orders through local fulfilment.
1.2. Depending on the product and order, products may be supplied from participating stores, brands, Hive-operated inventory or other fulfilment locations.
1.3. The applicable seller for a product will be identified on the relevant product, order or transaction information.
2. Eligibility and Use
2.1. You must be 18 years or older to use HiveNow and place orders.
2.2. You agree to use HiveNow only for lawful purposes and in accordance with these Terms.
2.3. You must not misuse HiveNow, interfere with its operation, introduce malicious software, attempt unauthorised access, or engage in fraudulent, abusive or unlawful activity.
3. Account Registration
3.1. You may be required to provide accurate and complete information, including your name, mobile number, email address and delivery details.
3.2. You are responsible for the accuracy of the information provided and for activity carried out through your account.
3.3. HiveNow may suspend or restrict accounts involved in fraud, misuse, repeated false claims, promotional abuse, payment abuse or other violations of these Terms.
4. Products and Listings
4.1. Product information, including images, descriptions, prices, sizes, colours and other specifications, may be provided by the applicable seller.
4.2. Sellers are responsible for the accuracy of information and representations relating to their products.
4.3. HiveNow does not guarantee that colours, appearance or other visual characteristics displayed on a device will exactly match the physical product.
4.4. Product availability is subject to change and an item may become unavailable before an order is confirmed.
5. Orders and Payments
5.1. Placing an order constitutes a request to purchase the selected product(s), subject to availability and confirmation.
5.2. An order may be cancelled or declined where products are unavailable, incorrectly listed or priced, or where required for operational, security or legal reasons.
5.3. HiveNow may correct pricing, listing or availability errors and, where applicable, provide a refund for amounts already paid.
5.4. Payments are accepted through the payment methods made available on HiveNow, including online payment methods and supported pay-later services. Cash on Delivery is not currently available.
5.5. The amount payable may include the product price, applicable HiveNow platform/service fee and applicable taxes or other charges, which will be displayed before payment.
6. Delivery
6.1. HiveNow aims to deliver eligible orders within 90 minutes, subject to product availability, location and operational conditions.
6.2. Any delivery time displayed or communicated by HiveNow is an estimated delivery time and not an unconditional guarantee.
6.3. Delivery may be affected by traffic, weather, store preparation time, product availability, customer location, delivery-partner availability, operational issues, technical issues or circumstances beyond HiveNow's reasonable control.
6.4. Delivery is available only in areas served by HiveNow and may be subject to applicable delivery charges.
6.5. If delivery cannot be completed because of an incorrect or incomplete address, inability to contact the customer, customer unavailability or other circumstances attributable to the customer, the order may be returned to the applicable seller/fulfilment location.
6.6. Where appropriate, HiveNow may manually coordinate another delivery attempt with the customer. Re-delivery may be scheduled for an available time between 11:00 AM and 7:00 PM, subject to operational availability.
7. Cancellation
7.1. Because HiveNow operates on rapid fulfilment and products may be prepared or dispatched shortly after an order is placed, cancellation may not be available once an order has entered processing, preparation or dispatch.
7.2. Where cancellation is available, the applicable option will be communicated through the app or customer support.
7.3. Any refund arising from an eligible cancellation will be processed through the applicable payment channel, subject to the relevant payment provider's processing timelines.
8. Returns, Refunds and Exchanges
8.1. Return and exchange eligibility may vary by product, seller and brand and will be communicated on the relevant product or order page.
8.2. Certain products or sellers may be marked non-returnable or final sale.
8.3. Notwithstanding a product's general return policy, HiveNow's customer protection applies where a customer receives an item that is wrong, damaged, stained, defective, materially different from the order, or otherwise materially not as described, subject to verification.
8.4. Customers must report eligible issues within the applicable period specified by HiveNow and may be required to provide photographs, videos or other information to assist verification.
8.5. Products approved for return must generally be returned in the condition required by the applicable return policy, including applicable tags, packaging and accessories.
8.6. Refunds, where approved, will be processed for the amount actually paid by the customer, subject to applicable adjustments, discounts, fees and the relevant refund policy.
9. Customer Protection and Seller Responsibility
9.1. HiveNow facilitates the customer experience, including technology, payment facilitation, fulfilment and customer support.
9.2. Sellers remain responsible for the authenticity, quality, legality, description, specifications and condition of products supplied by them, except to the extent applicable law provides otherwise.
9.3. HiveNow may take reasonable steps to investigate complaints, coordinate returns/refunds and resolve customer issues.
9.4. Nothing in these Terms limits any rights or remedies available to consumers under applicable law.
10. Promotions and Offers
10.1. HiveNow may offer discounts, coupons, referral benefits, promotional campaigns and brand-specific offers from time to time.
10.2. Individual offers may have additional terms, eligibility requirements, validity periods, minimum order values or maximum discount limits.
10.3. Offers may not be combined unless expressly stated otherwise.
10.4. HiveNow may withdraw or modify an offer where permitted by law, including where misuse, fraud or technical errors are identified.
11. Intellectual Property
11.1. HiveNow and its licensors own or have the right to use the HiveNow name, logo, software, technology, designs, text, graphics and other platform content.
11.2. You may not copy, reproduce, modify, distribute, reverse engineer or commercially exploit any part of HiveNow without prior written permission.
12. Fraud and Misuse
12.1. HiveNow may suspend, restrict or terminate access where it reasonably believes an account is involved in fraud, false claims, return abuse, promotional abuse, payment misuse, harassment, illegal activity or other misuse of the platform.
12.2. HiveNow may cancel affected orders and take other lawful measures to protect customers, sellers, delivery partners and the platform.
13. Third-Party Services
13.1. HiveNow may use third-party service providers for payments, logistics, communications, technology infrastructure and other operational functions.
13.2. Your use of third-party services may also be subject to their applicable terms and policies.
14. Limitation of Liability
14.1. To the maximum extent permitted by applicable law, HiveNow will not be liable for indirect, incidental, special or consequential losses arising from your use of the platform.
14.2. HiveNow does not guarantee uninterrupted or error-free availability of the platform or that every product, seller or delivery service will always be available.
14.3. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
15. Indemnity
15.1. To the extent permitted by law, you agree to indemnify and hold harmless HiveNow, Beelyn LLP and their directors, employees, agents and service providers from claims, losses or expenses arising from your unlawful use of HiveNow, fraud, misuse of the platform or breach of these Terms.
16. Privacy
16.1. Your personal information is handled in accordance with HiveNow's Privacy Policy.
16.2. By using HiveNow, you acknowledge that certain information is required to provide services including account management, payments, order fulfilment, delivery, customer support and applicable communications.
16.3. HiveNow may share necessary information with relevant sellers, delivery partners, payment providers and service providers to fulfil your order and provide the requested services, in accordance with applicable law and our Privacy Policy.
17. Changes to These Terms
17.1. HiveNow may update these Terms from time to time.
17.2. Updated Terms will be published on the HiveNow app or website and will apply from the effective date stated therein.
